TERMS & CONDITIONS

These Terms & Conditions (the “Agreement”) constitute a legally binding contract between you (“you” or “your”) and FTE North Texas LLC, doing business as Apogee North Texas (“Apogee NTX”, “we”, “us”, or “our”), governing your access to and use of our website apogeentx.com (the “Site”) and related services (collectively, the “Services”).

 

By accessing or using the Services, you agree to be bound by all of these Terms. If you do not agree, please discontinue use immediately.

1. AGREEMENT TO TERMS

  • This Agreement applies to your use of the Site.

  • Use constitutes implied consent (“browsewrap”) and, where applicable, clickwrap consent if you explicitly check an “I agree” box.

2. INTELLECTUAL PROPERTY RIGHTS

  • All content on the Site—text, logos, images, videos—is our property or licensed to us.

  • You may view and use materials for personal, non‑commercial purposes only. Any other use requires our written permission.

3. USER CONTRIBUTIONS

  • If the Site allows comments or contributions, you retain ownership of your submissions.

  • By making contributions, you grant us a worldwide, royalty‑free license to display, reproduce, modify, and distribute that content.

4. THIRD‑PARTY LINKS

  • The Site may contain links to third‑party websites.

  • We are not responsible for their content or policies and users access such links at their own risk.

5. USER REGISTRATION

  • If registration is required, you agree to provide accurate information and to safeguard your credentials.

  • You are responsible for all activity under your account and must notify us of unauthorized access immediately.

6. ACCEPTABLE USE & PROHIBITED ACTIVITIES

You agree not to:

  • Engage in illegal, harassing, or abusive behavior

  • Upload viruses or harmful code

  • Spam or scam other users

  • Circumvent security measures or infringe others’ rights

Violation may lead to removal or legal action.

7. SUSPENSION & TERMINATION

  • We reserve the right to suspend or terminate your access at any time if you violate these Terms.

  • You may delete your account at any time by following site‑specific procedures.

8. SITE MANAGEMENT & SUPPORT

  • We may update, limit, or discontinue site features at our discretion.

  • Routine maintenance or technical issues may cause temporary disruption of services.

9. PAYMENT & PRICING TERMS â€‹

  • Prices and availability are subject to change without notice.

  • $500 non-refundable/non-transferable Registration Fee is required to reserve each child's spot ($225 of your Registration Fee is applied to 1st month's tuition.)

  • $500 per child non-refundable Supply Fee of is due July 1 (max. $1,000 per family.)

  • We offer two tuition payment options*:

  1. Pay in Full by June 15 (3% discount)

  2. 10 monthly installments, beginning July 1

* 3% processing fee added to all credit/debit card payments: no charge for ACH/direct deposit.

10. REFUND POLICY 

We ask that you give us a 30-day written notice by email to the Program Director. To avoid being charged for the following month, that notice must be received before the 1st of the month.

 

For example:

  • If you send your notice on October 31, you will not be charged for December.

  • If you send it on November 1, you’ll still be responsible for December’s tuition.

        * Prorated or partial-month refunds are not provided except in the case of military relocation.

 

11. PRIVACY POLICY

  • Use of the Site is also governed by our Privacy Policy, posted at apogeentx.com/privacy‑policy.

  • Please review it to understand our information practices.

12. LIMITATION OF LIABILITY

  • We provide our Services “as‑is” and do not warrant uninterrupted or error‑free performance.

  • To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages.

 

13. GOVERNING LAW

  • The laws of the State of Texas govern this Agreement, without regard to conflict of law principles.

 

14. DISPUTE RESOLUTION & INDEMNIFICATION

  • You agree to indemnify and hold Apogee NTX harmless from claims arising from your breach or misuse.

  • Any disputes will be resolved under Texas jurisdiction.

 

15. CORRECTIONS & INACCURACIES

  • We attempt to maintain accurate site content but do not guarantee correctness.

  • We may update or modify information at any time without liability.

 

16. MODIFICATIONS & INTERRUPTIONS

  • We may change or suspend any portion of the Site at any time, including content, features, or terms.

  • We are not liable for interruptions due to technical or natural events beyond our control.

 

17. DISCLAIMERS & WARRANTIES

  • The Site and Services are provided without warranties of any kind, express or implied.

  • You use them at your own risk.
